§ 1 Scope
These Terms apply to all contracts for the purchase of the digital software "Advanced Haptics" between Nico Sagolla, Am Durchlaß 12, 88175 Scheidegg ("Provider") and the customer, concluded via this website. Deviating conditions of the customer do not apply.
§ 2 Conclusion of contract
The presentation of products does not constitute a binding offer. By completing the payment process, the customer submits a binding offer. The contract is concluded upon confirmation of the purchase or provision of the license key.
§ 3 Prices and payment
The prices stated at the time of order apply. As a small-business owner under § 19 UStG, no value-added tax is shown. Payment is processed via the offered payment service provider (e.g. Stripe).
§ 4 Delivery and provision
Provision is digital: the license key is sent to the provided email address after receipt of payment. Use requires compatible hardware and software (see the product description and EULA).
§ 5 Usage rights / License
The granting of usage rights is governed by the End User License Agreement (EULA), which applies additionally.
§ 6 Right of withdrawal
Consumers have a right of withdrawal in accordance with the Right of Withdrawal. For digital content, the right of withdrawal may expire early (see there).
§ 7 Warranty and liability
Statutory warranty rights apply. The Provider's liability is governed by the provisions of the EULA; otherwise liability is – to the extent permitted by law – limited to intent and gross negligence.
§ 8 Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Should individual provisions be invalid, the remainder of the contract remains effective.
